The management service or other service shall be provided by the manager of the Development as appointed under the Deed of Mutual Covenant or the third party service provider may at its sole discretion to determine the charges of management service, terms of use, operation hours, service period and the provision of management service in accordance with the terms stipulated in the Deed of Mutual Covenant, service agreement and other related legal document. The manager will provide different types of recreational activity facilities or activities according to the interests and demands of the residents. All the above facilities or activities are merely the initial proposals of the manager, subject to the actual provision after handing over of the residential properties and the final building plans approved by the relevant government authorities or the requisite consent or licence to be obtained therefor. The third party service provider will provide the relevant service in accordance with the actual condition. Each type of recreational activity facilities will be charged at different rates applicable to the corresponding time slots, and may not be made available for use upon handing over of the residential properties. The manager reserves the absolute right to change, amend, suspend or determine the arrangement of any of the relevant services arranged by the manager or third party service provider according to the actual circumstance. Any change, amendment, suspension or determination of one of the relevant services shall not constitute or be construed as constituting the Vendor giving any misrepresentation and/or committing a breach of any undertaking or warranty.
